Order
Any order is validated:
– either by acceptance of a quotation.
– or by validation of a proposed offer or package.
The order becomes firm and final after written acceptance by the client and, where applicable, payment of the requested deposit.
Moonspaceart reserves the right to refuse any order in case of prior dispute or non-payment.
Prices
Prices are expressed in euros (€).
They are those in force at the time of the order and may be revised at any time for future services.
The indicated prices include only the services expressly mentioned. Any additional request will be subject to a supplementary quotation.
Payment Terms
Unless otherwise stated:
– a deposit may be required upon order.
– the balance is payable upon project delivery.
Any late payment automatically results in:
– suspension of ongoing services.
– immediate payment of all amounts due.
Completion Timeframes
Completion timeframes are provided for information purposes only.
They may vary depending on:
– the complexity of the project.
– the client’s responsiveness (content, approvals, feedback).
Moonspaceart cannot be held responsible for delays attributable to the client.
Client Obligations
The client undertakes to:
– provide accurate and complete information.
– supply the content necessary for project completion.
– comply with validation deadlines.
The client guarantees that they hold the rights to the elements provided (texts, images, logos).
Intellectual Property
Creations produced by Moonspaceart remain its property until full payment of the service.
After full settlement, the rights of use of the website are transferred to the client, excluding third-party elements subject to license.
Moonspaceart reserves the right to mention the works as commercial references.
Maintenance and Updates
Maintenance or update services are not included unless otherwise stated.
Any additional intervention will be subject to:
– either a separate contract.
– or one-off billing.
Liability
Moonspaceart undertakes to provide its services with diligence and professionalism.
Its liability cannot be engaged in case of:
– improper use of the website.
– malfunctions related to third-party services.
– data loss beyond its control.
Right of Withdrawal
In accordance with applicable legislation, the right of withdrawal does not apply to customized services whose execution has begun with the client’s agreement.
Moonspaceart reserves the right to terminate any service in case of non-compliance with these T&Cs.
Force Majeure
Moonspaceart’s liability cannot be engaged in the event of force majeure preventing the normal performance of the service.
Disputes and Applicable Law
These T&Cs are governed by French law.
In case of dispute, an amicable solution will be sought before any legal action.
Failing this, the competent courts will be those within the jurisdiction of Moonspaceart’s registered office.
Amendment of the T&Cs
Moonspaceart reserves the right to amend these T&Cs at any time.
